1. GENERAL

1.1. The conditions apply to the legal relations entered into by the owner of the sales environment www.toysplanet.ee   (e-store) PLUSTOR OÜ (Merchant), address Karjavälja tee 4, Mustamäe,  13416 Tallinn, Estonia, registry code 12769102, VAT code EE101766654, info@toysplanet.ee, and the buyer (Customer) upon making a purchase.
1.2. In addition to these terms and conditions, the legal relations arising from the purchase of the products via the e-store shall be regulated by the legal acts valid in the Republic of Estonia.
1.3. The Merchant reserves the right to change the general terms and conditions of the e-store as well as the prices of products and services. Changes shall be disclosed in the e-store environment. Transactions shall be performed according to the conditions and prices valid at the moment of the performance of the transaction.

2. PRICE

2.1. The displayed prices include the VAT 20% valid in the Republic of Estonia.
2.2. The fee for the selected delivery type shall be added to product prices during the placement of the order. The delivery type shall be chosen and the fee for delivery shall be calculated in the shopping cart.

3. PLACEMENT OF ORDER

3.1. After the selection of the item and, if necessary, the item size, the item shall be added to the shopping cart by clicking on the button “Add to shopping cart”.
3.2. In the shopping cart, the Customer may change the quantity of items and remove them from the cart.
3.3. To place the order, the Customer has to click on “Place order” – the Customer shall be directed to the order placement page. After entering the required data, the Customer shall be directed to the payment options page.
3.4. The order shall be considered placed after the payment of the invoice.
3.5. After payment, the Customer shall receive a confirmation of the order on their e-mail address.

4. PAYMENT

4.1. The orders placed in the web environment shall be fully paid in advance.
4.2. The Customer may pay with bank wire, banklinks (Nordea, Swedbank, SEB).
4.3. Payment shall take place in a secure environment outside the e-store – upon payment via a bank link in the secure environment of the selected bank. Payment options is madiated by Maksekeskus AS. The Merchant does not have access to the Customer’s bank and credit card data.
4.4. After the placement of the order and payment, the Customer shall receive an order confirmation via e-mail.

5. DELIVERY OF ITEMS

5.1. Products ordered through TOYSPLANET E-shop can be transported across Estonia and also to other countries.
5.2. The products are delivered by Omniva courier service to specified address or to Omniva package cabines.
5.3. If not otherwise specified, the processing of the delivery shall be paid by the Customer.
Orders over 50 EUR are free of charge (only Estonia).
5.4. The orders shall be processed and mailed usually on the same or latest next working day. The arrival of the order depends on the postal service. Approximate arrival periods are in Estonia: 1-4 working days

6. CANCELLATION OF ORDERS, RETURN OF PRODUCTS

6.1. The Customer is entitled to withdraw from the transaction within 14 calendar days as of the receipt of the goods .To return the products, the Customer must fulfil the returns form and return the items to the Merchant. The accompanying return costs shall be incurred by the Customer.
6.2. The Customer is obligated to return the goods to the Merchant within 30 days as of the submission of the return application.
6.3. The returned item must be unused including all the labels and packaging. The return shall only be accepted together with a filled-out returns form.
6.4. The postal fees for the return of the item shall be incurred by the Customer. We recommend using registered mail.

7. ORDER CANCELLATION BY MERCHANT

7.1. If the goods ordered by the Customer are out of stock, the Merchant shall cancel the order. The order may be cancelled partially or fully. The Customer shall be informed of the cancelled order immediately. In case of partial cancellation, the Merchant may ask the Customer for specifications on how to process the rest of the order – whether to deliver or cancel as well.
7.2. Upon the cancellation of the order, the paid amount shall be returned to the Customer as soon as possible, but no later than within 30 days.

8. WARRANTY

8.1. The Merchant provides a warranty of 2 years in the event of the items’ non-conformity or defects as of the delivery of the items to the Customer.
8.2. Upon discovering a non-conformity or defect, please inform the Merchant thereof immediately.
8.3. The prerequisite of returning an item is the invoice issued to the Customer.
8.4. In the event of the non-conformity or defect of an item, the Customer is entitled to demand the replacement of the item with a defect-free item that corresponds to requirements or return the item at the Merchant’s cost.
8.5. Upon returning an item in the event of non-conformity, the sum paid for the item, including delivery costs, shall be transferred to the bank account indicated by the Customer within at least 30 days as of the return of the item.
8.6. The Merchant shall not be responsible for the non-conformity or defects of the item, if:
8.6.1. The item has deteriorated/been damaged by the fault of the Customer;
8.6.2. The defects have emerged due to non-intended use, including failure to follow maintenance instructions;
8.6.3. The item has deteriorated due to natural wear and tear resulting from ordinary use.

9. OTHER TERMS AND CONDITIONS

9.1. The data regarding the Customers and their orders preserved in the ordering environment of the e-store are treated as confidential information. The Merchant shall not disclose the acquired data to third parties.
9.2. Data communication between the Customer and the card payment centre is encrypted, guaranteeing the security of the Customer’s personal data and bank requisites. The Merchant does not have access to the Customer’s confidential bank and payment card requisites.
9.3. Disputes arising between the Customer and The Merchant shall be settled by negotiations. The Merchant shall respond to the complaints of the Customer by e-mail within at least 5 working days. Upon failure to reach an agreement the Customer may turn to the Consumer Protection Board or Harju County Court.

The settlement of disputes shall proceed from the legislation of the Republic of Estonia.
